Terms of Service
These Terms of Service ("Terms") are a binding agreement between you and Seens, a Public Benefit Corporation, part of Junction ("Seens," "we," "us," or "our"), and they also serve as the End User License Agreement for the Seens app. By creating an account or using Seens (the "Service"), you agree to these Terms. If you do not agree, do not use Seens.
Zero tolerance
Seens has zero tolerance for objectionable content and abusive users. Content that is illegal, sexually exploitative, harassing, hateful, or otherwise objectionable is prohibited. We remove it, and we remove the people responsible. See Section 4.
1. Who can use Seens
You must be at least 13 years old to use Seens (or older if your local law requires a higher age to consent to the processing of your information). By using Seens, you represent that you meet this requirement and that you are able to enter into these Terms. If you use Seens on behalf of an organization, you represent that you are authorized to accept these Terms for it.
2. Your account
You sign in with Sign in with Apple. You are responsible for activity on your account and for keeping access to it secure. Notify us promptly at [email protected] if you believe your account has been compromised. You may delete your account at any time from within the app.
3. Your content
You own the content you create on Seens. To operate the Service, you grant us a limited, non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display your content solely to provide the Service to you and the people you choose to share with. This license ends when you delete your content or your account, except for content others have independently saved consistent with our in-app rules, and except where we must retain material to comply with law. You are responsible for the content you post and for having the rights to share it.
Seens is built on honest provenance. You agree not to misrepresent the source of a photo — for example, presenting an imported or generated image as a live in-app capture.
4. Acceptable use — objectionable content and abuse
Seens has zero tolerance for objectionable content and abusive users. You agree not to post, upload, share, or transmit content, or engage in conduct, that:
- Sexually exploits or endangers a minor in any way, including child sexual abuse material (CSAM). This is strictly prohibited and reported to authorities.
- Is pornographic or contains nudity or explicit sexual content.
- Depicts non-consensual intimate imagery, or shares private or intimate images of a person without their consent.
- Harasses, bullies, threatens, or intimidates any person, or incites others to do so.
- Promotes hatred or violence against people based on race, ethnicity, national origin, religion, disability, sex, gender identity, sexual orientation, age, or any other protected characteristic.
- Is illegal, promotes illegal activity, or facilitates the sale of illegal or regulated goods.
- Depicts graphic or gratuitous violence, or promotes self-harm.
- Impersonates another person or misrepresents your identity or affiliation.
- Infringes anyone's intellectual property, privacy, or other rights.
- Contains spam, scams, malware, or attempts to compromise the Service or other users.
5. Reporting, blocking, and enforcement
We give every user tools to stay safe and keep the community clean:
- Filter. We use automated and human review to detect and remove objectionable content, including hash-matching for known CSAM at upload.
- Report. You can report any post, message, or account from within the app. We review reports of objectionable content and act on violations, and we aim to remove violating content and respond within 24 hours.
- Block. You can block any user, which prevents them from contacting you or interacting with you.
- Contact. You can reach our Trust & Safety team any time at [email protected].
We may remove content, and suspend or terminate accounts, that violate these Terms — with or without notice. We report known CSAM to the National Center for Missing & Exploited Children (NCMEC) as required by U.S. law, and we cooperate with law enforcement where legally required. Ejected users are not permitted to return.
6. Payments and paid features
Some features may be offered for a fee (for example, business events, creator channels, keepsake storage, or optional subscriptions). Purchases made through the app are processed by Apple and are subject to Apple's terms in addition to these Terms. Pricing and available features may change over time. Any refunds are handled according to Apple's policies.
7. Our intellectual property
Seens, including its software, design, branding, and the "Grain" identity, is owned by us and protected by law. We grant you a personal, non-transferable, non-exclusive, revocable license to use the app as intended. You may not copy, modify, reverse engineer, or resell the Service except as permitted by law.
8. Termination
You may stop using Seens and delete your account at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or if necessary to protect the Service or its users. Sections that by their nature should survive termination — including content licensing for already-shared content, disclaimers, and limitations of liability — will survive.
9. Disclaimers
Seens is provided "as is" and "as available," without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that content shared by other users is accurate or lawful.
10. Limitation of liability
To the fullest extent permitted by law, Seens and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, use, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim, or one hundred U.S. dollars ($100).
11. Indemnification
You agree to indemnify and hold harmless Seens from claims, damages, and expenses (including reasonable legal fees) arising from your content, your use of the Service, or your violation of these Terms or of any law or the rights of another.
12. Governing law
These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in Florida will have exclusive jurisdiction over any dispute that is not otherwise resolved, except where prohibited by your local law.
13. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you in the app. Your continued use of Seens after an update means you accept the revised Terms.
